Three UK JBL Snow Party Social Media Prize Draw Terms & Conditions – March 2022

These terms and conditions are the rules which apply to this Prize Draw. By submitting an entry, entrants will be deemed to have agreed to be bound by them.

Promoter

1. Three UK JBL Snow Party (“Prize Draw”) is organised by Hutchison 3G UK Limited, trading as Three, of Great Brighams Mead,1 Vastern Road, Reading, Berkshire RG1 8DJ (“Three” or “We”). The Prize (as defined at paragraph 6 below) is administered and provided by HARMAN Consumer Nederland B.V t/a JBL (the “Administrator”).

Dates

2. The Prize Draw opens on 07/03/22 at 12pm and closes on 08/03/22 at 12pm (“Promotion Period”).

Eligibility

3. To be eligible to enter the Prize Draw entrants must be over 18 years of age and a UK resident and have a valid passport which permits entry to the applicable Airport as defined in paragraph 6 (“Eligible Entrants”). Entrants may be required to provide photographic ID to Three and/or the Administrator to prove their eligibility. This Prize Draw is not open to employees, agents, contractors, or consultants of Three or the Administrator, or anyone professionally connected with the Prize Draw.

Entry

4. To enter the Prize Draw, Eligible Entrants must reply in the comments section of the relevant post on @ThreeUK’s Instagram page, tagging a friend and using snowflake emoji during the Promotion Period (“Qualifying Entries”).

Rules

5. The following rules shall also apply to the Prize Draw:

a. Only one entry per Eligible Entrant will be considered by Three and entered into the Prize Draw. Entries in excess of this limit will render all entries made by that person void.

b. Late entries will not be taken into consideration in winner selection.

c. Each entrant warrants that all information submitted by them is true, accurate and complete and Three is not responsible for any information which is invalid or incomplete, including contact details.

d. Three reserves the right to exclude and/or disqualify any entry which it deems, in its sole and absolute discretion: (i) to be offensive or inappropriate; (ii) fails to comply with these terms and conditions; and/or (iii) to be contrary to the spirit or intention of the Prize Draw.

e. Each Eligible Entrant confirms that they are and will be: (i) available; and (ii) eligible to travel to and from the United Kingdom (including having a valid passport and visa if applicable and fulfilling all applicable COVID-19 travel rules), on and around the dates the winners will be needed for the Prize.

Prize

6. One winner will receive a trip package for two (2) persons to the JBL Snow Party 2022 in Val Thorens, France, scheduled to take place from April 21st 2022 until April 24th 2022 (the “Event”). The package consists of the following: two (2) tickets to the Event; two (2) round trip economy-class airfares to/from the destination airport closest to winner’s residence and a destination airport of either Geneva, Switzerland or Lyon, France, (the “Airport”) as determined by the Administrator at its sole discretion*; three (3) nights hotel accommodation (all inclusive) in one double room at Club Med Val Thorens Sensations hotel in Val Thorens, France; ground transportation between hotel and Airport, food and beverage provided for certain events at certain days/times; and ski hire for April 22nd, 2022 – April 24th, 2022 (“Prize”). Only one Prize per winner will be awarded. Prize allocation remains at Three’s sole and absolute discretion.

(*) in the event a flight is not feasible due to the departure location of the winner, Administrator shall in is sole discretion designate another form of transportation.

Selection of winners

7. The winner will be randomly selected by a computer process, under independent supervision, from all Qualifying Entries on 09/03/22. The decision will be final and Three will not enter into any correspondence. 

Contacting the winners

8. Reasonable efforts will be made by Three to contact the winner of the Prize via direct message to the Instagram account used to enter the Promotion by 5pm on 09/03/22. Eligible Entrants should ensure their Instagram settings enable Three to contact them in this way and check their Instagram direct messages between 9am and 5pm on 09/03/22 and Three shall not be responsible in the event a winner does not claim the Prize because they have failed to do so. If the winner of the Prize cannot be successfully contacted, does not claim the Prize within 72 hours of notification (by responding to Three), or is unable to comply with these terms and conditions, Three reserves the right to offer the relevant Prize to another Eligible Entrant (who will be selected in the same manner described in paragraph 7). Failure to respond or failure to meet the eligibility requirements may result in forfeiture of the Prize.

Redeeming the Prize

9. The winner of the Prize will be required to provide a valid email address to receive their Prize. The winner may also be required to submit additional valid identification before receiving the Prize. Acceptable forms of identification remain at Three’s sole and absolute discretion. The Administrator shall use reasonable endeavours, subject to these terms and conditions, to fulfil the Prize as soon as reasonably possible after the winner has claimed it and confirmed their correct email address.

10. If a winner not available or eligible to travel on the dates they will be needed for any elements included within the Prize, for any reason, that winner will not be eligible for the Prize and no alternative prize will be offered to that winner. All costs and expenses not included in the Prize are the responsibility of the winner (including, for the avoidance of doubt, any costs connected with the winner’s eligibility to travel).

Privacy

11. Both Three and JBL operate as controllers independent of each other in respect of any personal data that entrants supply when entering this Prize Draw. Three and JBL shall use such personal data to administer and fulfil this Prize Draw in accordance with Three’s Privacy Policy (available at www.three.co.uk/privacy-safety/privacy-policies), JBL’s Privacy Policy (available at https://uk.jbl.com/privacy-policy.html) and these terms.

12. The winners of the Prize will be asked when they are contacted by Three (as described in paragraph 8) whether they consent to their first name and entry being used in any Three marketing activity across some or all media channels.

13. The surname and county of the winner can be obtained after 17/03/22 by sending an email to DLUKMarketingPRSocial@three.co.uk within 28 days after the date of the closing date of the Prize Draw. If you object to this information being published or made available, please contact the Promoter. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.

General

14. The Prize is not transferable or exchangeable. No cash alternatives will be offered. Three and the Administrator reserve the right at any time to substitute the Prize and/or certain elements of the Prize for an alternative of similar or greater value where circumstances beyond our control makes it necessary to do so. Further, we reserve the right to amend these terms and conditions (including altering the Prize) at any time without notice by updating these terms and conditions and publishing them at three.co.uk/terms.  No communications will be entered into by Three regarding this. No purchase is necessary to enter this Prize Draw, however an internet connection is required.

15. This Prize Draw is in no way endorsed by, sponsored by, associated with or administered by any third parties including Instagram.

16. All third party terms and conditions relating to the Prize Draw or the Prize itself are beyond our control. Three cannot accept responsibility and will not be liable for any failures to abide by any or all third-party terms applicable to the Prize.

17. Three cannot accept responsibility for entries lost, corrupted, or delayed in transmission or for the failure by any winner to check their emails (including junk folder) or voice messages. Under no circumstances will Three (or its parent, subsidiaries and affiliated companies) be liable (unless such liability cannot be lawfully excluded) for any losses, damages, costs or expenses arising from or in any way connected with any errors, defects, interruptions, malfunctions or delays in the Prize Draw or the Prize (or any aspects of them), and Three excludes liability, to the fullest extent permitted by law, for any loss or damage caused to a winner of the Prize arising out of or connected to the Prize or this Prize Draw. Statutory rights are not affected.

18. Entry into the Prize Draw signifies your acceptance of these terms and conditions. These terms are governed by English law.
