Terms and Conditions for Anytime Upgrade

1. The Anytime Upgrade promotion (“Promotion”) is run and operated by Hutchison 3G UK Limited trading as Three, Registered Office: 450 Longwater Avenue, Green Park, Reading, Berkshire, RG2 6GF (“Three”, “We” or “Us”).

Promotion Details and Eligibility

2. This Promotion allows eligible customers (defined below) to upgrade their Airtime or SIM Only plan without paying a Cancellation Fee (as defined in our Price Guides found here) when purchasing a new Device on a new Device Plan agreement.

3. To be eligible to benefit from this Promotion you must:

(a) be a consumer customer who upgrades with Three directly either through our retail store, online or over the phone. This Promotion is not available to business customers or to customers who buy their Plan through one of our partners;
(b) have a Three Your Way Airtime or SIM Only plan (“Qualifying Plan”). If you have purchased your Airtime or SIM Only plan before 30th January 2023, it may not be a Three Your Way plan and you may not be eligible for this Promotion;
(c) have had your Qualifying Plan for more than 90 days from the Commencement Date (as shown in your Customer Agreement Form); and
(d) upgrade your Qualifying Plan to a new Airtime or SIM Only Plan with an equivalent or higher data allowance than your existing Plan.
(e) Purchase a new Device with a new Device Plan agreement.
Three will then waive the Cancellation Fee for your Qualifying Plan when you upgrade. However, you will still be responsible for any payments due under an existing Device Plan agreement.

4. If applicable, you can choose to retain or trade in your existing Device when you upgrade. If you choose to trade in, you can use the trade in value to pay off all or part of your existing Device Plan agreement or you can apply it to your new Device Plan agreement. You can also choose to trade in your Device and receive the trade in value as a bank payment. Please see

General

5. Under no circumstances will Three (or its parent, subsidiaries and affiliated companies) be liable (unless such liability cannot be lawfully excluded) for any losses, damages, costs or expenses arising from or in any way connected with any errors, defects, interruptions, malfunctions or delays in this Promotion (or any aspects of them), and Three excludes liability, to the fullest extent permitted by law, for any loss or damage caused arising out of or connected to this Promotion.

6. Three reserves the right, acting reasonably and in accordance with all relevant legislation and codes of practice, to vary the terms and conditions of the Promotion (including, without limitation, to cancel, modify or supersede the Promotion) by changing these terms and conditions. No correspondence will be entered into by Three.
